Abstract Of Title

The family law in the Qur’an
Family which is the smallest part of a society consists of spouses and children.
Just as the permanence of human being depends on the family association,
the healthy, regular and peaceful continuity of the social life is based on
this association built on firm ground as well.
Qur’an contains all ethical and jural arrangements which are necessary to
sustain family life from the very beginning in a comfortable and peaceful
way.
Because man and woman in the family are tranquil and complement each
other through the senses such as “love and mercy” bestowed on them by
Allah, the most intimate relationships among people start in family.
Social solidarity comes into existence by the means of families formed ethical
and jural arrangement.
In addition to family law in the Qur’an, there are ethical elements such as
virtuousness, goodness and honesty. Roman Emperor Ausgus and French
Marshal Paten declared to those wanting to fulfill their hedonistic emotions
by avoiding having spouses and children “the results of this life style would
be serious and bad for their societies.”
Supreme Allah does not want human beings to live according to their desires
and simple hedonisms and living alone. For that reason, Supreme Allah says
“Get singles married…” By declaring “Your wives are your garments and
you are their garments…” the importance of family which becomes legal
through the contract between spouses is stressed in terms of ethic.
Ethical societies merely consist of normal marriages.
