Abstract Of Title

The principle of legality, which is accepted as one of the universal principles of modern criminal law, is generally accepted by all legal systems. Although it has a history dating back to Hammurabi and the Roman Laws in the sense that some of the crimes and punishments are determined, it is seen that the legality principle comes to the fore in the age of enlightenment within the scope of criminal rights. In the process of time, the principle has been included in the laws of many countries along with various inter-national conventions. In this study, the principle of legality has been discussed in terms of Qur'an and Sunnah, the main sources of Islamic law. Informing and warning before punishment is also a result of the understanding of justice and natural law. Basedon this principle, the traces of the principle are in-vestigated in the texts of Quran and Sunnah that highlight justice and law in every field.
